| 摘 要： | 人大的法律监督权与检察机关的法律监督权之间的关系之争由来已久。我国宪法规定人大的法律监督权是我国最高层次的监督权 ,同时亦规定检察机关是我国的专门法律监督机关 ,行使法律监督职能。在新时期 ,必须坚持和完善人民代表大会制度 ,亦必须从制度上保证检察机关依法独立公正地行使检察权。
