| 摘 要： | 法治是现代政府治理理念和治理模式的理性选择,它主要通过政府与市场、社会的法律关系框架而展开。契约作为一种理念,在横向层面内含政府、市场和社会主体自由、平等、互惠的价值诉求,在纵向层面也蕴含着政府履行职能、提供公共服务所应有的诚信与责任、秩序和效率的政府人格和施政理念。作为一种方法论,为横向和纵向契约理念结合的法治政府提供了应然性的法治逻辑与和谐社会的实践归宿。

| Abstract: | Rule of law,a rational choice for modern government＇ s ruling idea and ruling style,is implemented in form of legal relations among government,market and society.As an idea,contract contains the value of freedom,equality,reciprocity in an angle of lateral legal ties,and it implicates the characteristics of honesty and responsibility and the idea of order and efficiency that governments should have when they supply the public with public service or perform their duties.As a methodology,contractual theory provides government ruled by law with legal logic and the destination of harmonious society. |
