论我国器官移植犯罪的立法规定及其完善

《人体器官移植条例》关涉的犯罪包括可以直接进行理论解释的犯罪和需要修补、增设的犯罪两种情况。通过刑法解释,《条例》第25条"非法摘取人体器官"的刑事责任不能全部在刑法中得到回应和落实,因而无法做到全面"依法追究刑事责任"。因而,我国刑法需要增设器官移植犯罪方面的刑法条文,修正增补的方式可以继续采取《刑法修正案》的方式。增补这方面的犯罪既可以严密刑事法网,又有利于刑法典与附属刑法之间保持协调,同时也与世界各国和地区的刑法典规定保持一致。

On the Legislative Regulations and Its Integrity of the Crimes of the Transplantation of Human Organs

The crimes related to Regulations on the Transplantation of Human Organs include both the interpretation crimes and the additional crimes.By interpretation to criminal law,we can only make the criminal responsibility of the crime of illegal removal of human organs of article 25 of Regulations on the Transplantation of Human Organs carried out in the criminal law code partly,and so we can’t look into the criminal responsibility according to law in an all-round way.We need add the new criminal clauses and we may take the method of the amendments to the criminal law.To set up the crime of illegal removal of human organs,it is both beneficial to tighten the toils of criminal law and to coordinate the relationship between the criminal law code and affiliated criminal law.At the same time,it is helpful to make our criminal law code bring into line with the criminal law code of the other countries and regions.
