| 摘 要： | 为维护法律的权威 ,保障人们的合理预期 ,必须关注法律与社会秩序、法律的正式渊源和非正式渊源、历史、社会习俗和时代精神在司法审判中的地位 ,必须强调司法审判中法律的稳定性、法律的社会性、法律的人文精神、伦理道德等 ,用形式推理和实质推理共同完成司法审判的论证任务 ,有助于获得公正的司法审判

| Abstract: | This article discourses upon form reasoning and substance reasoning about judicial judgement.To vindicate legal authority and ensure people's reasonable anticipation,we must pay attention to status of law and social order,legal origin in due form and undue form, history,social conventions and the times spirit in judicial judgement,emphasize legal stabilization,legal sociality,legal humane spirit, ethic morality and so on in judicial judgement and accomplish argumentation assignment of judicial judgement by form reasoning and substance reasoning put together to obtain equitable judicial judgement. |
