| 摘 要： | 中国传统和谐思想对宋代司法审判影响很深,主要表现在审判中注重情理法相结合、允许亲族相讼、“鞫谳分司”的司法机构设置、注意保护弱者的权益、重视教育说服和息讼等五个方面。和谐思想是宋代司法的一个重要支撑。

| Abstract: | The profound effect of Chinese traditional ideology of harmony on judicature in Song Dynasty is characterized by five respects as follows： combining law with emotion and reason; allowing lawsuits among members of the same clan; establishing the judiciary of separating interrogation from conviction; protecting rights of the weak; and giving priority to education and persuasion and dropping lawsuits. Chinese traditional ideology of harmony greatly supports judicature in Song Dynasty. |
