| 摘 要： | 刑事诉讼中的追诉标准是侦查起诉中应重点把握的问题,应对追诉标准与定罪标准进行准确界分。立法是司法实践的反映,对贪污贿赂犯罪的追诉标准反映出检察机关对贪污贿赂犯罪定罪情节的认识,是在立案、侦查、提起公诉阶段从刑事实体法的角度分析贪污贿赂犯罪的认定问题,因而探讨其定罪情节在侦查起诉阶段的特征以及准确适用问题,对于检察机关惩治贪污贿赂犯罪有着极其重要的指导作用,并且也有利于从理论上对贪污贿赂犯罪进行研讨。我国刑法中的贪污贿赂犯罪的追诉标准是缺乏一定操作性的。从刑法理论上看,深化侦办此类犯罪的细则研究,对于增强刑法分则相关罪刑条文的实务操作性,将罪刑原理融合到刑事司法活动中,促进贪污贿赂犯罪的立法的与时俱进,有效地惩治和全面地预防贪污贿赂犯罪,具有积极的时代意义。
