| 摘 要： | 我国新刑法对单处罚金规定过少,无法发挥罚金刑替代短期自由刑的优越性.在适用过程中也出现执行难等问题,影响了罚金刑作用的发挥.文章从我国罚金刑存在的问题入手,提出应进一步完善相关立法,加强执行力度等措施,改善罚金刑的适用现状.

| Abstract: | The fine stipulated for one time is too little in Chinese new criminal law,so the superiority of fine penalty can't be brought into full play and replaces the short-term freedom penalty in the course of application.Such problem as difficult execution also arise,which influences the role-play of fine penalty.This passage begins with the problems existing in fine penalty and puts forward such measures as the further perfection power etc.to improve the present application situation of fine penalty. |
