| 摘 要： | 网络交易平台的地位日益成为网络交易中的核心问题，它直接关系到网络交易活动的顺利开展。网络交易的主体匿名性、空间的虚拟性、完成的非及时性，使现有的法律体系在网络空间的适用受到了极大的冲击。从网络交易的基本特征出发，对网络交易平台的法律性质和地位进行了深入分析，并对网络交易平台提供者的法律责任与普通平台提供者的法律责任进行了全面比较，提出了相应的建议。

| Abstract: | The position of online trade platform becomes the core problem of online trade,which directly affects the activities of online trade.The characteristics of online trade,such as its anonymity of subject,virtuality of space,and delay of accomplishment,which greatly attack the law system when it applying in the cyberspace.This paper describes the basic characteristic of online trade,analyzes the law property and positions of the online platform,compares the law responsibility of online trade platform providers with that of the common platform,and puts forward the relevant suggestions. |
