| 摘 要： | 国家法和苗族习惯法一直处于一种互相磨合的状态中,有国家法对苗族习惯法让步的情况,也有苗族习惯法补充国家法的不足并不断向国家法靠近的情况。不能将苗族习惯法看作法治的对立面,必欲遏制或以现代法取代之。从社会秩序形成的角度而言,苗族习惯法是对国家法的补充。在内容上与国家法有冲突的习惯法是在国家法能够容忍的限度内存在的,同时这种习惯法符合地方性的文化价值观,当地人认为其存在是合理的。

| Abstract: | National law and Miao customary law have long been in a state of mutual emergence.Miao customary law cannot be regarded as the opposite rule by law,but as an addition of constitutional law from the angle of forming social order. |
