网络中立帮助行为的刑法分析

近年来，网络中立帮助行为涉罪的案件频发，中立帮助行为因为其本身被法律所允许，所以可能促进犯罪结果的发生，其蕴涵着行为自由与法益保护的矛盾。网络中立帮助行为因其共犯从属性、法益侵害性、意思联络等发生变化而呈现出不同于传统中立帮助行为的特点。网络中立帮助行为多以不作为方式进行，笔者分别对搜索服务提供者、缓存和存储服务提供者、网络连接服务提供者应承担的义务和可罚性进行了分类讨论，以期明确中立帮助行为的刑法出罪和入罪标准，最终实现刑法行为自由与法益保护之间的合理平衡。

Criminal Law Analysis of Net Neutrality Help

In recent years, there have been frequent cases of network neutral help behavior involving crimes. Neutral help behavior is permitted by the law,but it may actually promote the occurrence of crimes.It implies the contradiction between freedom of behavior and protection of legal interests. The net neutral help behavior is different from the traditional neutral help behavior due to changes in its accomplices,legal interest infringement, and meaning contact. Network neutral help behaviors are mostly carried out in the form of inaction. The author discussed the obligations and penalties of search service providers,cache and storage service providers, and network connection service providers respectively, in order to clarify the criminal standard of neutral help behavior, and finally realize the reasonable balance between the freedom of criminal law and the protection of legal interests.
