依法治国与宪法司法化

依法治国的核心是依宪治国 ,要发挥宪法在依法治国中的作用 ,不应只停留在强调宪法为依法治国奠定了法律基础、为广泛主体提供了根本行动准则等方面 ,更重要的是要把宪法引入司法领域 ,通过宪法司法化强化宪法的法律效力 ,真正树立宪法权威 ,以宪法的司法化限制公共权力 ,规范国家机关依法行使职权 ,保护公民宪法中规定的基本权利和自由 ,推进依法治国进程。当前需要从认识我国宪法监督制度的缺陷入手 ,通过纠正人们对宪法认识上的偏差和建立符合我国国情的宪法司法制度 ,有效推进依法治国进程。

Administrating the Country by Law and Judicialization of the Constitution

Administrating the country according to the constitution is the core of administrating the country by law ,but in order to play a full part of the constitution in administrating a country by law ,we should not only stay at emphasizing that the constitution lays the law foundation of administrating the country by law and provides extensive people with basic behavior principles and so on.What is more important ,we should introduce the constitution into judicial field ,reinforce the constitution's law efficiency by judicializing it ,set up the authority of the constitution ,restrain the public rights ,regulate the organs of states to perform the power by law,safeguard the citizen's basic rights and freedom stipulating by the constitution ,promote the process of administrating the country by law .At present, we should start with recognizing the deface of our country's constitution supervision system,promote the process of administrating by law efficiently by correcting people's misunderstanding of the constitution and establishing the constitutional judicial system which is in accordance with China's national condition.
