动物福利与人权的冲突及应对之策

动物福利立法在中国举步维艰,其中一种反对观点认为在中国当前的国情下,实施动物福利法会与中国的人权保障发生冲突,即提高动物福利会影响人的福利。针对这种观点,笔者在中国西部某生猪生产大省就猪的福利与养猪农民充分生活水准权的冲突情况进行了调查。调查表明,较高标准的动物福利措施潜在地会对农户生活水平的提高产生负面影响,但以反残酷为基础的较低标准的动物福利仍然有为农民所接受的可能。基于这一调查,本文提出＂低限动物福利＂,作为中国当前制定动物福利法的立法策略,即以反残酷为底线,以较低标准的动物福利为补充的动物福利法,并建议政府对实施动物福利给予适当补贴,或者采取降低税收等其他有效方式弥补农民的利益损失。
