| 摘 要： | 随着科技创新重要性的日益凸显以及科技研发专业化分工与合作的不断加强，许多企业、事业单位等主体作为第三方通过联合资助、合作研发或转委托等方式参与到国家各级各类财政资助科技项目中。为完善国家资助科技项目研发与投资行为，必须合理配置和正确维护第三方参与人的知识产权利益。具体而言，要科学恰当地界定第三方的范围及种类、深入具体地分析第三方与项目承担单位之间、不同种类的第三方之间并妥善解决其利益冲突．同时当其权利配置在合同优先的情况下，应进一步建立完备的合同监管制度并提供有效法律救济措施。
