民间文学艺术表达的法律保护初探

作为传统知识体系的三大主题之一,民间文学艺术表达的保护引起了国际、国内社会的广泛关注。在我国面对民间文学艺术表达被任意使用、破坏乃至失传而亟待法律保护的状况,法律却缺少具体保护的措施。这需要廓清民间文学艺术表达的内涵,明确保护的主客体,设计合理的民间文学艺术表达保护模式。

Initial Probe into the Protect of Folklore Art Expression in Law

As one of the three themes of traditional knowledge system,the protection of folklore art expression has attracted much focus by the society at home and abroad. The current situation is that such expression has been used arbitrarily, damaged and it is in urgent need of protection in law, however, there lacks specific protection measures in law. The connotation of such expression should be expurgated, the protection subject and object should be clarified,and the protection model should be designed.
