| 摘 要： | TRIPS协议对知识产权保护的高标准既没有实现各方利益的平衡,也难推动技术革新和新技术的传播与转让。TRIPS协议的规则很难保证其目的和宗旨的实现,因此,我们必须根据公平正义、人权原则、人类共同利益等法价值理念重构其规则。
