关于违宪审查制度的几个问题

违宪审查制度作为宪政国家的基石,是指国家的权威机构为保障宪法的实施,对国家机关、政党组织和社会团体的立法或行为的合宪性进行具有法律效力的审查和裁决,并对违宪立法或行为予以纠正和制裁的制度。纵观世界各国违宪审查制度的发展趋势,在全面审视违宪审查的内容、方式、效力的基础上,结合我国实际应尽快建立健全我国的违宪审查制度。

Several Issues on Constitutional Review System

Constitutional review,fundamental for a nation of constitutional government,refers to a system in which,to ensure the fulfillment of the constitution,the authoritative institution of the state has the legal authority to review and arbitrate the constitutionality of the legislation or actions performed by state organs,party organizations and social bodies,and to redress and punish those unconstitutional ones.Based on an overview of the development of constitutional review in the world,and an examination of its contents,methods and effectiveness,this paper argues that the constitutional review system should be established and perfected as soon as possible in China.
