网络证据保全公证的现实困境与完善建议——以上海市黄浦区人民法院的知识产权审判实践为样本

网络证据保全公证日益成为权利人固定侵权证据的首要选择，特别是在侵犯网络著作权案件中，网络证据保全公证往往是认定侵权能否成立的关键。但网络证据保全公证并非尽善尽美，公证过程中大量存在的瑕疵，使得公证书受到当事人的广泛质疑和反驳，如何认定有瑕疵公证书的效力成为困扰审判实践的普遍难题。在对上海市黄浦区人民法院近四年知识产权审判实践进行实证分析的基础上，对网络证据保全公证的特点以及网络公证实践中存在的瑕疵进行了分析，指出了网络证据保全公证之所以存在大量瑕疵的原因，并提出了相应的完善建议，希望对今后网络证据保全公证行业的发展有所裨益。

On the Realistic Predicament and Perfection Suggestion of Network Notarization for Evidence Preservation: Studies on the Intellectual Property Trial Practice of Shanghai Huangpu District People's Court

Network notarization for evidence preservation has become the first choice for the obligee to preserve tort evidence, especially in the network copyright tort cases, in which the network notarization usually is the key to determine whether the defendant implemented the infringement. However, network notarization for evidence preservation is not perfect. Many flaws in the network notarization make the notary certificate subject to wide query and refutation by the parties. How to determine the validity of the defect notary certification becomes the common difficult disturbing the trail practice. Based on the intellectual property trial practice of the shanghai huangpu district people's court, this paper analyzes the features of the network notarization and its flaws in trial practice. Then this paper points out the reasons why the flaws exist and puts forward some corresponding advice which will be helpful to the development of network notarization industry for evidence preservation.
