论物权法律适用的分割制

与传统物之所在地法的适用相对应的是 ,当代涉外物权法律适用呈现出明显的分割化走势。这一走势在物权的行为能力 ,物权的行为方式 ,物权的保护 ,货物所有权的转移 ,船舶、飞行器等物权关系 ,无体动产 ,运输中的货物等领域中都有所体现。这一走势形成的原因主要有法律关系的竞合、物权法的一定程度的任意性、物权公示方式的多元化、“物权适用物之所在地法”这一冲突规则本身的缺陷、冲突规范的软化发展趋势等。中国国际私法有关物权法律适用的规定应当在相关领域体现这一走势。

China private international law relating to law applicable to property right should embody this trend in the relative field.
