人权本原的"人性"论——简论李步云先生的人权本原观

人权根源于人性,即人的自然属性与社会属性,二者的辩证统一构成了人权的本原,这就是李步云先生在人权本原上的“人性”论。“人性”论的成因在于三个方面:对天赋人权理论合理成分的吸收,对各种人权本原理论的批判以及李步云先生的法哲学思想。追根溯源,“人性”论发端于四个方面:怎样从国家政治中证成人权?怎样从市场经济中证成人权?怎样从文化传统中证成人权?怎样从人性中证成人权?“人性”论充分表达了李步云先生平等、对抗、和谐与宽恕的人权精神。

On human nature of the origin of human rights

On the origin of Human Rights,Li bu-yun pointed that Human Rights originated from human nature which includes natural character and social character.The thought of origin is composed of three factors: the absorption to reasonableness of natural rights,the result to criticize all kinds of the theories of origin and the thought of Jurisprudence himself.The mind of origin exposed four questions: where are Human Right from in politics? where are Human Right from in economic markets? where are Human Right from in traditional culture? where are Human Right from in Human Nature? The mind of origin expressed four spirits of Human Rights that includes equality,confrontation,harmony and forgiveness.
