| 摘 要： | 黑格尔法哲学思想是西方法学史上的一座丰碑,近代法哲学的最高成就。黑格尔认为,法学是哲学的一个部门,国家是伦理观念的现实,法则是自由意志的定在。黑格尔法哲学的本质在于高扬人的自由本性,批判封建专制,实际上为近代资产阶级革命提供了论证。

| Abstract: | Hegel's philosophy of jurisprudence is a milestone in Western legal history and the most successful achievement in modern philosophy of jurisprudence.In his opinion,the science of law is one branch of the science of philosophy,nation is the realization of the idea of ethics,and law is the dasein of freewill.The nature of Hegel's philosophy of jurisprudence lies in his advocacy of human free nature and his criticism about feudal dictatorial system,which justifies the bourgeois revolution and laws. |
