检察机关贯彻宽严相济刑事司法政策研究

实行宽严相济的刑事司法政策是我国司法机关的一项重要政策，特别是在构建和谐社会的背景下显得尤为重要。当前我国检察机关在贯彻这项政策时存在着执法观念滞后，宽严尺度把握不准，办案人员业务素质不高，执法考评不科学，矫治机制不健全，工作机制不协调，执法力量不足等，只有针对这些问题制定切实可行的时策，才能更好地实现宽严相济的刑事政策。

The criminal judicial policy of tempering justice with mercy is an important one of our country's judicial organ,and is especially important in the background of constructing harmonious society.At present,in carrying out the policy,the procurator organ of our country faces the problems as lagging behind in executing the law,not correctly controlling the scope of being strict and being at the mercy,the low competence of the law-executors,the unscientific way in checking the process of executing the law,the incomplete of the correcting system,the inconsistence of working system and the inadequateness in the number of the executors.Only by taking practical countermeasures solving these problems,can the policy of tempering justice with mercy be better carried out.
