法律内在道德的逻辑与启迪——基于富勒法律道德性理论的中国法治思考

法律的内在道德构成了冨勒法律与道德关系理论的精髓。对于法律的内在道德,应当从三个依次递进的方面予以理解和把握:法律的内在道德存在自身内部的张力和矛盾;法律的内在道德主要是一种愿望的道德;法律的内在道德使法律成为一项事业。法律的内在道德在促成规则之治、引领公民启蒙和推进对话协商三个方面对中国法治实践具有启示意义。

Logic and Enlightenment of Internal Morality of Law: Thoughts of Chinese legal Administration Based on Fuller's Theory of Morality of Law

The internal morality of law constitutes the essence of Fuller's theory of the relationship between law and morality.The internal morality of law should be understood and grasped from the following three progressive aspects:the internal morality of law has its own tension and contradiction;the internal morality in law is largely the morality of wishes;the internal morality of law makes a cause of law.Its combination with our realistic life helps understand better Fuller's original idea of the morality of law.The internal morality of law offers inspiration for China's legal administration in the following three aspects:enhancement of regulation administration,guidance of citizens' enlightenment,and promotion of negotiation by dialogue.
