| 摘 要： | 为了适应社会主义市场经济的建立和发展以及随之而来的婚姻家庭观念的变迁和财产关系的复杂化，2001年《婚姻法》制定了较为完善的夫妻约定财产制，但这一制度在立法上仍存在缺陷，有待进一步完善。
