立法解释与法官解释关系探析

我国正式法所规定的法律解释只包括立法解释和具体应用解释两种,其实质都为广义的立法解释,这显然与法学方法论研究者所讨论的法律解释即法官解释大相径庭。尽管立法解释与法官解释在涵义、性质、解释主体、对象和目的等方面存在诸多差异,但两者各有其独立的存在价值,并且二者在司法过程中可以实现衔接与合作。此外,立法语言的准确性以及立法解释调整范围的广泛性等也都证明,法官解释无法取代立法解释的地位。
