| 摘 要： | 全国人大《关于司法鉴定管理问题的决定》的实施使我国司法鉴定体制发生了重大变革，集中体现在司法鉴定机构的市场化运行机制的确立，赢利性成为其最大的特点。然而无序的司法鉴定收费对弱势群体的证据采集形成障碍，急需建立司法鉴定法律援助制度以适应体制改革的需要。我国司法鉴定法律援助制度的模式选择应为界于国家福利型和社会主导型的一种中间类型，并立法对受援对象、条件及法律援助主体做出明确规定。

| Abstract: | There has been a basic law about present legal aids matters. With the implementation of the law i.e. ＂The Decision on the Problems about Expert Testimony Management＂ made by CPC, there have been a lot of changes on expert testimony management system. In order to adapt to these changes, the foundation of expert testimony legal aid system is needed badly. The mould of the expert testimony legal aids system in China should be in the middle of the moulds between the national welfare mould and society-oriented mould. Definite regulars should be made to the legal principal body and conditions and objects of the expert testimony legal aids. |
