| 摘 要： | 在村委会选举中,可能出现因被提名候选人拒绝参选,或村民态度冷漠而不参加选举,以及候选人为3人以上且支持者势力相当等情形而导致村委会选举制度失灵的状况,针对这种失灵,通常可采取补充性措施来积极应对:第一,设立候选人登记制度作为提名候选人的后续程序;第二,增设基层人民政府直接任命村委会成员的制度作为选举方式的补充;第三,可采用相对多数规则作为绝对多数规则的补充。

| Abstract: | Institutional failure may occur in the election of village committee members since the nominated candidate may refuse to participate,the villagers may be indifferent,or the candidates are more than three and they are equally competent.In such a case,the election is unable to proceed.To solve this problem,all candidates should be registered,the grassroot government should be entitled to administrative nomination,and the rule of relative majority should be adopted as a compensation when absolute majority fail... |
