| 摘 要： | 我国法学领域对"亲亲相隐"持否定态度,但"亲亲相隐"精神并不必然与现代法治相违背.许多现代国家的刑法中存留有"亲亲相隐"的条文,一些国家的刑事诉讼法中也有一些"亲亲相隐"的规定.将我国传统法文化中"亲亲相隐"的有关理念引进现代法制体系中,建立符合我国国情的容隐权制度,有益于观照传统,维护亲情,促进社会的和谐、稳定与发展.

| Abstract: | In the field of Chinese laws, "concealment among relatives" is denied, but the spirit of "concealment among relatives" is not inevitably against modern rule of law. There are some clauses about "concealment among relatives" in criminal laws of many modern countries, and there are also some regulations about it in the law of criminal procedures in some countries. Introducing "concealment among relatives" of traditional law culture into modern legality and establishing the system of toleration and concealment rights in accordance with Chinese reality is good for consideration of traditions, protection of relatives affection and promotion of social harmony, stability and development. |
