| 摘 要： | 国内学者对法律规范逻辑结构的不同意见在一定程度上与国外学者有关观点上的差异存在关联性,需要参考现代西方法理学的相关论著才能较好地加以理解.国外学者在法律规范逻辑结构观点上的分歧主要是与不同学者对于什么是法律规范(法律规则)这一问题存在不同的答案相关,由于对此有不同理解,他们对于法律规范有哪些要素存在分歧,而这种分歧集中体现在法律规范逻辑结构中是否应当具备"制裁"或者说"后果"的问题上,关于法律规范逻辑结构的其他方面的争议亦与该问题有关.国内学者通常不区分"法律规范"与"法律规则"的做法缺陷相当明显,体现在法律规范逻辑结构问题上的大量争议,其来源都可以归结到这种混用.在充分意识到国内学者在有关理论前提上所存在的差异的基础上,参考国内外学者对法律规范逻辑结构的分析,可以将一个法律规范(而非法律规则)认为系由行为模式与法律效果两大部分组成,并可以进一步将行为模式划分为规范主体、规范内容、适用条件三个部分.
