| 摘 要： | 通常情况下,医疗机构与患者之间是医疗合同关系。为使患者得到及时的医治,从维护患者的生命健康权益考量,对于危急患者,医疗机构负有强制缔约义务,非有正当理由,不得拒绝患者的请求。医疗机构所负有的强制缔约义务是法定的民事义务,在医疗机构违反该义务且给他人造成损害时,应该承担缔约上的过失责任。
