| 摘 要： | 法律依据的不完善,导致在审理行政不作为违法赔偿案件时,是否给予行政赔偿以及赔偿数额多与少存在模糊性。通过对域外相关法制的考察并对我国法律、司法解释的解读,得出审判实务中突破法律规定给予行政赔偿的合理性。针对目前行政赔偿整体偏低的现实问题,提出相应的改善建议：提高行政赔偿标准;否定性行政判决与行政赔偿判决双管齐下;行政赔偿与民事赔偿并行不悖。

| Abstract: | The imperfection of the legal basis results in ambiguity regarding whether to grant the administrative compensation and the amount of compensation,when a case of administrative omission compensation is tried.Through a study of related legal systems overseas and relevant Chinese laws and judicial interpretations,the paper argues that it is rational to break through some laws on administrative compensation.Some constructive proposals are made to change the current low compensation rate in China,such as raising administrative compensation standards;negative administrative decision and administrative compensation judgments to be carried out together;executive compensation and civil compensation going hand in hand. |
