医疗救助过程中精神障碍者重要权利的立法保护

精神卫生问题愈来愈受到国际社会的广泛关注,许多国家相继通过立法形式对精神障碍者的重要权利予以保护。鉴于我国目前尚无针对精神障碍者权益保护的专项法律法规,文章借鉴国际各国立法,比较分析了国外精神障碍者在医疗救助过程中权利保护的立法和实践经验,并充分论证了我国两部精神卫生法草案的优点与不足,探寻精神卫生法草案的遗漏,认为我国的精神卫生法应与国际接轨,加快完善医疗过程中精神障碍者重要权利的保护,维护私权体系的完整。

Legal Protection for the Important Rights of the Mentally Incapacitated in the Process of Medical Assistance

There has been wide concern over the mental health issues in the international community.Many countries protect the important rights of the mentally incapacitated through legislation.Because there is no special laws and regulations for protecting the rights of the mentally incapacitated in China,this paper makes a comparative analysis of the advanced legislation and experience in practice for protecting the rights of the mentally incapacitated in the process of medical assistance,fully demonstrates the deficiency of the draft of Mental Health Act and the advantages and disadvantages of the two drafts of Mental Health Act with reference to legislation in many foreign countries and explores the omission in the draft of Mental Health Act.It is suggested that our Mental Health Act should conform to the international development,speed up the perfection of the legislation for protecting the important rights of the mentally incapacitated and maintain the integrity of private right system.
