| 摘 要： | 遗产分割的效力应采取移转主义。遗产分割中共同继承人瑕疵担保责任的依据在于实现共同继承人间的公平,遗产分割方法并不影响继承人之间应有部分之相互移转,仅影响遗产由共同共有转变为各继承人单独所有的物权变动效力。遗产分割后,各共同继承人以其所分得的遗产份额为限,对其他共同继承人所得的遗产瑕疵,与出卖人有同一的担保责任。各共同继承人对其他共同继承人所分得的遗产债权,以遗产分割时债务人的支付能力为限,负担保责任。

| Abstract: | The division’s effectiveness should take the transfer principle.The basis of joint heirs’ flaw guaranty in division of heritages lies in realizing the joint heirs’ justice;the division methods do not affect the mutual transfer of due part between the heirs,but the effect of property rights alteration that heritage from coparcenary to each heir single ownership.After the division of heritages,each joint heir limits his share,and burdens the same guarantee liability with the seller.Each joint heir limits the obligor’s capacity to pay when the heritages are being divided,and burdens the guarantee liability to legacy creditor’s rights of other common heirs shared. |
