| 摘 要： | 民国时期，中国近代以来西方法文化与本土传统法文化的博弈并未结束。传统婚姻观念与习惯，在民间仍然固守着自己的领地，从而导致国家制定法与民间习惯在司法上的冲突。以婚约为标本对此进行法社会学考察，探索二者调适和整合的路径，于当下仍可以为借鉴。

| Abstract: | In the period of Republic of China,the conflict between the new law system and civil customs lasted.This article will try to analyse the characteristic of the legislation of engagement of Republic of China concretely,then the situation of folk engagement concretely in the period of Republic of China,so we may learn something from history. |
