法社会学视野中的社区矫正制度

社区矫正是近年来兴起的一种新型的矫正模式,通过把罪犯置于开放环境,即社区中进行教育改造来实现既能够达到惩戒罪犯,彰显法律权威的目的,又能够使罪犯与社会的发展保持协调一致,实现从犯罪人向社会人的转变。社区矫正制度能够克服监禁刑矫正模式存在的诸多弊端,有利于提高再社会化质量,对于我国完善社会主义市场经济,全面建设小康社会,建设社会主义政治文明,实现人的全面发展有着重要意义。当然,必须看到,我国社区矫正制度尚处于摸索之中,如何确立适合我国发展要求的社区矫正制度,并非易事。本文结合发达国家社区矫正经验,提出了建立和完善我国社区矫正制度基本设想,即观念更新、制度保障、专门机构和人员、相关机构分工配合、前瞻性调研等。

Community Correction Systemin in Legal Sociological Perspective

Community correction is one of the new correction patterns these years.It corrects offenders by putting the offenders in the open environment,such as community,in order to not only correct offenders and display law authority,but also keep offenders up with the social development and change from offender to social human.So community correction system is important.But we must know that our community correction system is not perfect and it is difficult for us to set up a community correction system suitable for us.The article shows us the basic thoughts,such as sense renews,system guarantee,special organization and staff,division of labor of correlated organization,investigation and research,etc.
