| 摘 要： | 软实力建设对于中国国家发展战略有巨大推动作用,为了有效建设国家软实力,必须提高我国的＂国内软实力＂。＂国内软实力＂是一国政府或者执政党对于本国公民的吸引力,以保证自己能够长期执政。加强我国＂国内软实力＂建设离不开法治作为支撑,一方面要提高制度建设的水平,充分发挥制度所具有的预防纠纷、减少冲突的功能;另一方面,当前中国正处于社会转型期,城乡二元结构的差异要求法官在化解矛盾、解决纠纷的时候注意采用恰当的立场。
