论社会保障权和我国社会保障立法的完善

社会保障权是现代社会中的一项基本人权,具有普遍性、法定性、非对等性和复合性。现代社会保障制度的建立是对公民社会保障权的确认,国家有责任、有义务去建立完善各项社会保障制度,确保公民社会保障权的实现。我国非常重视公民的社会保障权,先后制定了一系列社会保障法律、法规,但还存在一些不足。因此,必须完善社会保障立法,确保公民社会保障权的实现。应继续扩大社会保障的覆盖面,提高社会保障水平,形成系统完整的社会保障法典,赋予公民社会保障的救济权利。

On Citizens' Social Security Right and the Improvement of China's Social Security Legislation

The social security right,a basic human right in modern society,is universal,legal,non-reciprocal and compound.To establish a modern social security system is to recognize citizens' social security right. The state has the duty and obligation to establish and improve a social security system and guarantee the realization of such social security right.China pays a high premium on its citizens' social security right and has formulated a series of laws and regulations in this regard.Considering the deficiencies,China is to improve the legislation for social security to guarantee the realization of its citizens' social security right.It is suggested that social security coverage be extended,social security standard be improved,systematic social security code be formulated,and social security remedy right be entrusted to all citizens.
