| 摘 要： | 《物权法》对土地承包经营权的规定系以现行《农村土地承包法》为基础，区分以家庭承包方式获得的土地承包经营权和“四荒”土地承包经营权，对后者仅实行债权保护，力度不够；对登记对抗效力主义中的第三人在解释上宜限于与土地承包经营权人处在相互矛盾的法律关系立场上的人，以更周延地保护土地承包经营权；应丰富土地承包经营权的流转方式，对“其他方式”采宽泛解释，但是对割裂性流转如转让等仍应持谨慎态度。

| Abstract: | The rules with respect to land contractual operation right in the Property Law are based on the Rural Land Contract Law now in effect.The rules impose different treatments to the land operational right obtained through family contractual manner and the "Four Wastes" land contractual operation right;protect the latter one only through the creditor's rights,which is not enough.The third party mentioned in the registration Antagonism rule had better to be limited to the persons who are on the opposite position to the land contractual operation right owner in the legal relationship,so that the land contractual operation right can be protected more comprehensively.The circulation measures for the land contractual operation right shall be enriched,"other measures" shall be interpreted broadly,however,cautious attitude shall be kept as to the split circulation such as transfer. |
