墨西哥反倾销法及其对中国的影响

在新自由主义经济改革的进程中,墨西哥逐步形成了兼有国际法渊源和国内法渊源的反倾销法律体系。《墨西哥对外贸易法》及其实施条例规定了反倾销措施的实体要件———倾销、损害或损害之威胁以及二者因果关系的确定方法。近十年来,墨西哥从调查数量、征税额度和比例以及产品范围等方面来看,都构成反倾销的重要国家之一,对包括中国在内的“非市场经济国家”影响甚大。这既源于墨西哥的宏观经济背景及其反倾销立法缺陷,也有我国企业自身的原因。我国政府、行业协会和出口企业必须积极应对,采取有针对性的反倾销策略,确保我国更多产品进入墨西哥市场乃至拉丁美洲市场。
