英国文物返还事务处理机构工作评析:标准及其实践

为应对二战以来各国针对英国提起的文物返还请求,英国设立了专门的文物返还事务处理机构“掠夺建议委员会”。在综合考虑法律、道德、买受人是否善意、公共利益等标准的基础上,掠夺建议委员会将作出提出返还请求、同情性补偿、驳回请求人请求等三种建议。委员会提出建议时的考量因素,对于我国此后向英国主张类似权利具有较强的借鉴意义。

Analysis on work of agency of relics return affairs in Britain (SAP):standards and practices

In order to deal with the requests from foreign countries for retrieving cultural relics spoliated by Britain since World War II, a special committee called “Spoliation Advisory Panel”(SAP)was set up by British government. Based on the comprehensive consideration of the legal standard, moral standard, the good faith of the buyer, and the public interests, SAP will make three types of proposals such as claiming the request of return, sympathetic compensation, and rejecting request of the claimants. The factors considered by SAP in making proposals have important significance for China to claim similar rights to Britain.
