| 摘 要： | 诈欺破产罪是侵害债权的主要犯罪。通过对中外的一些刑法关于诈欺破产罪的规定的比较,揭示诈欺破产罪的法律特征。为了惩罚诈欺破产罪,保护债权,我国刑法应增设诈欺破产罪的罪名、罪状和法定刑。

| Abstract: | Bankruptcy fraud is the main crime of trespassing creditor's rights.With a comparison of different regulations about bankruptcy fraud in Chinese and Foreign Criminal Law,the legal characteristic of bankruptcy fraud is revealed.In order to punish bankruptcy fraud and protect the creditor's rights,accusation,facts about the crime and prescribed penalty of bankruptcy fraud ought to be added in the Criminal Law of China. |
