论民生与法治的辩证关系

一个国家的民生状况与其法治状况密切相关,保障民生需要充分发挥法治的功能。同时,民生理念融入法治之中,也为法治发展注入新的活力,对法治建设提出更高更新的要求。加强民生法治建设,必须充分发扬民主,确保民生立法的科学性、民主性和公平性;政府要切实履行职责,坚持依法行政和公正执法,为改善民生提供切实保障;司法机关应当从保护民生权利、救济民生利益的角度进行理念设计和制度安排,不断提高司法保障民生的水平。

The Dialectic Relationship between Livelihood and Rule of Law

Close relationship exists between the people＇s livelihood condition and that of rule of law in a country.The guarantee of livelihood needs full play of rule of law.Meanwhile,the integration of the idea of livelihood into rule of law adds new energy into the development of rule of law,and also puts forward new and higher demand for the construction of rule of law.To strengthen the construction of livelihood rule of law requires full development of democracy to ensure livelihood legislation to be scientific,democratic and just.Government should take the responsibility feasibly and adhere to administration by law and judicial justice in order to provide practical guarantee for improving livelihood.Judicial organizations should carry out idea designing and mechanism arrangement from the perspective of protecting livelihood right and remedy livelihood interest in order to improve the level of judicial protection of livelihood.
