| 摘 要： | 随着《反垄断法》的颁布实施,垄断协议将趋于隐性化,发现和认定垄断协议的难度也将随之增大。为了解决秘密垄断协议侦破难的问题,许多国家纷纷出台了宽大政策,中国在2007年颁布的《反垄断法》中也制定了宽大政策。从经济学的视角分析了宽大政策的理论基础,指出宽大政策通过改变卡特尔成员的参与约束或激励相容约束条件,可以对卡特尔起到威慑和瓦解效果;在此基础上,考察了中国宽大政策的现状,通过对比美国和欧盟的宽大政策,研究发现目前中国的宽大政策存在透明度低和不确定性大等诸多问题;最后给出了完善中国宽大政策的措施。
