| 摘 要： | 死亡赔偿金是因为死者的生命权受到侵害的特有赔偿项目。死亡赔偿金具有财产损害赔偿与精神损害赔偿二重性。我国在死亡赔偿金方面的法学理论、立法与司法实践出现不同认识与误解,并因此导致在侵权损害赔偿中同命不同价的城乡差别现象。消除在死亡赔偿金方面的城乡差别,应当从理论源头建构符合损害赔偿目的性的体系。
