我国立法博弈产生的原因和条件:“两个假设”与社会转型

随着改革开放的深入,我国的立法博弈时代已经到来。立法过程涉及不同的利益主体,他们之间进行着激烈的利益竞争,最终作用于立法的结果。但是深入这些现象的背后,我们不难发现立法博弈形成的根本原因与重要条件。资源的稀缺性与利益主体的"经济人"属性是立法博弈形成的根本原因,而我国当前正在经历的社会转型又是立法博弈形成的"导火索"。正是这"两种根本原因"与"一个现实条件"的结合才形成了我国当前立法博弈的局面。对以上问题的探讨,有助于我们深刻理解立法博弈的成因,进而为解决我国当前立法博弈过程中所面临问题提供理论支撑。

Two Hypotheses and Social Transformation: the Basic Reason and Important Conditions for the Game Theory in Contemporary China' s Law-making

With the depth of reform and open-up,the game theory in China's law-making comes into being.The process of law-making involves different interests,therefore,there are fierce struggles between them,which in turn imposes influence on the legislation.However,it is not difficult for us to find the basic reasons and important conditions for the game theory in legislation behind these phenomena.Specifically,the scarcity of resources and the monooeconomicus attribute of interest are the basic reasons while the social transformation that China is experiencing is the fuse.It is the combination of these two basic reasons and one realistic condition that results in the game theory in our country's contemporary legislation.The discussion of above-mentioned problems can help understand the motivation of legislation game theory and further provide theoretical support for the solution of legislation game theory.
