新型城镇化进程中失地农民权益保障研究

在推进新型城镇化过程中,要切实维护、保障广大失地农民的根本利益。然而,由于当前我国农村集体土地征用核算方式不合理,农村集体土地所有权行使主体不明确,针对失地农民的社会保障制度不完善,失地农民的法律救助制度不健全,直接导致了新型城镇化进程中失地农民权益保障的缺失。为了使广大失地农民共享改革与发展成果,在推进新型城镇化过程中,要通过"优化核算方式,规范征用程序;明确产权主体,厘清法律关系;健全社会保障,维护基本权益;完善法律援助,健全司法救济"等措施来最大限度地维护、保障与增进广大失地农民的权益,真正实现农民生活富裕、农业生产有序、农村和谐稳定。

Protection Issues on Land-lost Farmers' Rights in the Process of New Urbanization

In the process of new urbanization, the Party Central Committee and the State Council specially stress to maintain, safeguard and promote the fundamental interests of majority landless farmers. However, the accounting mode on rural collective land requisition is not reasonable, the ownership of rural collective land is not clear, the social security system on land-lost peasants is not perfect, the legal aid system on land-lost peasants is not perfect. All these reasons lead to the lack of protection of rights and interests of land-lost peasants in the urbanization process. In order to make land-lost farmers share the fruits of reform and development, in the process of new urbanization, we should take some measures, including ＂optimizing method of accounting, standardizing proce- dures of acquisition, clearing property rights, clearing the legal relations, perfecting the social security, safeguard- ing the basic rights and improving the legal aid and the judicial remedy＂. These measures could maintain, protect and enhance the rights of land-lost peasants. They can realize their wealthy life, make the agricultural production be order and realize the harmony and stability in rural areas.
