公正审判权在我国适用的立法完善——以《公民权利与政治权利国际公约》为例

在刑事诉讼中，审判的公正是决定刑事诉讼是否公正的关键环节。公正审判权作为国际范围的人权是以英、美、法“法律的正当程序”为理论基础的。很多国际人权条约都规定了公正审判权，尤其是1966年《公民权利与政治权利国际公约》的规定最为全面和详细，通过确立公正审判的最低限度标准来要求各国加强对公正审判权的保障。《公民权利与政治权利国际公约》与现行法律规定存在诸多冲突有一定关系，进一步修改和完善相关法律尤其是《刑事诉讼法》是我国实践公正审判权的前提。未来修改在符合国际标准的同时可以吸收各国刑事司法的经验，与国际公认的刑事司法准则和国际惯例相接轨，提升我国公正审判权的保障水平。

The Legislative Perfection of Fai r Trial Right in China---Taking International Convention on Civil and Political Rights as an Example

The fairness of trial is the key step in deciding criminal litigation .As the international human right ,the right of fair trial takes British ,American and French “due process of law”as its theoretical basis ,and has been included in many international human rights treaties ,esp .Interna-tional Convention on Civil and Political Rights in 1966 ,in which the regulations on the right of fair trial are the most comprehensive and detailed and all the countries are required to strengthen the security of fair trial right by setting the minimum standard for fair trial .There are quite a few conflicts between International Convention on Civil and Political Rights and the present laws ,so it is the premise of the practice of fair trial right in China to further modify and perfect the related laws ,esp .Criminal Procedure Law .The future modification should try to meet the international standard and meanw hile ,to take the experience of criminal justice of other countries for reference , and to keep in line with the internationally recognized standards of criminal justice and interna-tional practice so as to improve our security standard of fair trial right .
