农地流转信息失灵的法律规制

我国当前农地流转市场并非完全竞争市场,存在市场信息失灵现象,土地资源配置难以实现帕累托最优。因此,在我国当前农地流转中,政府应通过信息规制手段矫正农地市场信息失真状况,修复农地市场机制,从而实现土地资源的优化配置。政府对农地流转信息规制的对象为市场参与人的交易信息披露行为,重点是对市场信息的优势方——农村基层组织和涉农企业的信息披露行为进行规制。在我国当前农地市场信息规制中,政府应特别注重信息工具手段的运用,以规范管理流转当事人的信息供给与传递行为。

Legal Regulation of Information Failure in Farmland Transaction

China＆#39;s current rural land transfer market is not a completely competitive market .There exist the phenomenon of market information failure;and it is difficult for land to achieve the Pareto optimal al-location of resources .Therefore , in current circulation of agricultural land , the government information mechanism should be improved by regulating agricultural land market information , restoration of agricul-tural land market mechanism , in order to achieve optimal allocation of land resources .Regulations on government＆#39;s behavior of transaction information disclosure to market participants should focus on regula -ting the information disclosure of the advantageous parties---the rural grassroots organizations and agri-business.Also, the governments should pay special attention to the use of information tools to regulate the supply and delivery of information behavior to the transaction parties .
