行政垄断及其法律治理的基本思路

所谓行政垄断，也称超行政垄断或法定垄断，是指国家行政权力机关或经济管理部门凭借其经济管理权，违法行使职权，排斥、限制、禁止市场竞争，破坏社会主义市场竞争秩序的行为。从行为的具体表现形式来看，行政垄断可以分为地方贸易壁垒、部门贸易壁垒、政府限定交易及设立行政公司等形式。行政垄断的危害性主要表现为：阻碍了市场经济体制的建立；对政治秩序的扰乱；败坏了社会风气。行政垄断之所以在我国得以滋长蔓延，有着深刻的历史和现实原因。要反对行政垄断，就要从立法上、司法上以及执法上建立一整套完备的制度，但更重要的是，要依法推进经济体制改革，巩固经济体制改革成果，完善分税制，取消差别待遇，培育多元化的可竞争市场，依法保障市场对国民经济发展的基础调节作用，保证国家经济生活、政治生活的法治化。

The Thinking of Administration Monopoly and Legislation Control

Administration monopoly, known as the surpassing monopoly or the legal monopoly, refers to the illegal conducts of the state administrative organs or the economic management departments, that is, abusing the economic administrative power and undermining the competition order of socialist market. Administration monopoly falls into such forms as the local trade barrier, the branch trade barrier, the govermment limit to the trade and the administration company. It does more harm than good by hindering the establishment of the market economic system, disturbing the political order, and corrupting the public morals. There are both historic and present reasons that administration monopoly spread wildly in China so that it is required to set up a whole series of perfect systems in legislation, judicature and the law execution. It is even more crucial to promote economic system reform, enhance the reform achievement, cultivate a multi-outlet competitive market, safeguard the market adjustment to the national economic development, and keep the national economic life and plitical life under the legislative control.
