摘    要:职业安定是劳动者的基本利益,无固定期限劳动合同作为保障职业安定的基本制度不可动摇。稳定不等于僵化,灵活用工不等于短期用工,无固定期限劳动合同与灵活用工不存在本质上的矛盾。应妥当平衡劳动者职业安定与企业灵活用工的利益冲突。《劳动合同法》规定的无固定期限劳动合同的订立条件基本合理,但解除条件则略显严格。未来应适当放宽对无固定期限劳动合同解除的限制,并更多的采用经济性手段限制解雇。

Abstract:Occupational stability is the basic interests of labors.Non-fixed-term labor contract,as one of the most fundamental systems for occupation security protection,can not be questioned.Stability doesn not mean rigidity,and labor flexibility doesn not equal using workers for short terms at will.Non-fixed-term labor contract isn not contradictory to flexible labor using in nature.It is important to balance the interests between labors’ occupation security and company’s labor using flexibility.The conditions provisioned by Labor Contract Law upon which non-fixed-term labor contract must be formed are modest and feasible on the whole,while the conditions to terminate the contract are too strict relatively.The discharge of non-fixed-term labor contract should be made easier,and more economic tools should be used to restrict discharge of contracts.
