论行政强制执行主体的设置模式

随着政治、经济体制的变革,命令式的直接管理行为逐渐减少,随之行政处罚、行政许可等间接管理方式逐渐增多,而当行政相对人不履行法定义务时,行政强制执行的作用就凸现出来了,其中执行主体模式的设置尤为重要,本文就现行行政强制主体设置模式形成的原因、现行行政强制主体模式设置的缺陷及行政强制执行主体设置制度的完善作一探析。

With the transformation of Chinese political and economic system,authoritative direct management behaviors are on the decline.Meanwhile,more indirect management methods are being adopted.When the administrative counterpart does not fulfill the legal duty,administrative enforcement will play a more necessary role.For the time being,the setting pattern of administrative enforcement subject becomes particularly important.This essay aims to explore the reasons,defects for the setting pattern of present administrative enforcement subject and perfection measures of this system.
